2. Scope

These terms and conditions apply to all use of the website my-heirloom-story.com and the associated application (hereinafter "the Service"). By creating an account or using the Service, you fully accept these terms.

3. Description of the Service

My Heirloom Story is a digital platform that allows users to:

  • create and manage a family archive (photos, documents, memories, journal entries)
  • invite family members to contribute to the archive
  • store sensitive information in a secure vault
  • record wishes and inheritance plans
  • transfer the archive to heirs via a life check-in process and trusted contacts

The Service is accessible via a web browser. A mobile app may be offered in the future.

4. Subscriptions and pricing

The Service is offered under the following plans:

Free Limited features with no time limit. No payment required.

Monthly subscription — €5.99/month Full access to all features. Billed monthly with a minimum commitment of 3 months. Cancellable monthly after the initial 3-month period.

Annual subscription — €59.99/year Full access at a reduced price. Cancellable annually.

Founders (Lifetime) subscription — €99.00 (one-time) until 31/12/2026, thereafter €149.00 Lifetime access with no further payments. Non-transferable — see article 8.

All prices are inclusive of any applicable Belgian VAT, or exclusive of VAT if the provider benefits from the small business VAT exemption scheme. This will be clearly indicated at the time of purchase.

We reserve the right to change prices. Existing subscriptions continue at the price at which they were taken out until the end of the current subscription period.

5. Payments

Payments are processed by Stripe, a certified payment service provider. By taking out a subscription, you agree to Stripe's payment terms.

Monthly and annual subscriptions renew automatically unless cancelled in advance. You will receive a reminder email before each annual subscription renewal.

In the event of non-payment or chargeback, we reserve the right to restrict or suspend access to the Service.

6. Right of withdrawal

For consumers in the European Union:

You have the right to withdraw from a subscription within 14 days of conclusion without giving any reason.

Exception for immediate use: When you expressly request immediate access to the Service at the time of purchase and acknowledge that you thereby lose your right of withdrawal once the Service has been fully performed, that right is lost at the moment you actually make use of the paid features.

This is in accordance with the applicable EU consumer law (Directive 2011/83/EU on consumer rights, Article 16(m)).

To exercise your right of withdrawal (if still applicable), contact us at info@my-heirloom-story.com with the subject "Withdrawal" and your account details. We will process your refund within 14 days using the same payment method.

7. Cancellation and termination

You may cancel your subscription at any time via the settings in the application. Cancellation takes effect at the end of the current billing period. You retain access to your account until that date.

After your subscription ends, your data is retained for a maximum of 12 months, after which it is permanently deleted. You can export your data or permanently delete your account via the settings before that deadline.

When your account is permanently deleted, all data is erased within 30 days, with the exception of legally required financial records which are retained for 7 years.

We reserve the right to immediately terminate an account in cases of abuse, fraud or serious breach of these terms.

8. What happens to your subscription when you pass away?

The Founders (Lifetime) subscription is not transferable. It is a personal licence that expires upon the death of the original holder.

When a death is reported and confirmed in the application, the following happens automatically:

  • The original family archive is placed in read-only memorial mode — all memories, photos, journals and heirlooms remain permanently accessible to family members.
  • Heirs who were members of the family are moved to their own new family, automatically created by the application.
  • These new families receive 3 months of free Premium, automatically activated at the moment of the fork.
  • After 3 months the family automatically reverts to the free plan. An email reminder is sent 7 days before the Premium period ends.
  • No paid subscription from the original holder is carried over after the 3-month period.

Family members who wish to continue using Premium features after the 3-month period can subscribe independently via the pricing page.

9. Use of the Service — Code of conduct

You agree to use the Service only for lawful purposes and in accordance with these terms. It is prohibited to:

  • upload content that infringes copyright or other third-party rights
  • use the Service for unlawful activities
  • attempt to circumvent or disrupt the technical security of the Service
  • provide false or misleading information

10. Intellectual property

Your content: You retain all intellectual property rights in the content you upload (photos, documents, texts). By uploading content, you grant us a limited, non-exclusive licence to process and store that content solely for the purpose of providing the Service.

Our Service: The software, design, the brand name "My Heirloom Story" and all other elements of the Service are the property of Peter Van Boom and are protected by applicable intellectual property law.

11. Liability

We strive to provide a reliable and available Service but cannot guarantee absolute availability. We are not liable for:

  • temporary interruptions to the Service due to maintenance or technical issues
  • loss of data resulting from circumstances beyond our control (force majeure)
  • indirect, consequential damages or loss of profits

Our total liability towards a user is limited to the amount that user has paid in subscriptions during the 12 months preceding the damage.

We are not responsible for the legal accuracy of information you store in the application. The Service is a storage tool and does not provide legal, financial or notarial advice.

12. Availability and maintenance

We aim for Service availability of at least 99% on an annual basis, excluding planned maintenance. You will be notified in advance of planned maintenance where possible.

13. Governing law and dispute resolution

These terms are governed by Belgian law. In the event of a dispute, the parties will first attempt to reach an amicable settlement.

If no amicable settlement is reached, the courts of Oost-Vlaanderen shall have exclusive jurisdiction.

As a consumer, you also have the option of using the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

14. Changes to these terms

We reserve the right to amend these terms. For material changes, we will notify you by email at least 30 days before they take effect. If you do not agree with the amended terms, you may cancel your account before the effective date.
